1. Ownership of the website
In accordance with the provisions of article 10 Law 34/2002, of July 11, on Information Society Services and Electronic Commerce, we inform you that the page https://www.gimenezlecuona.com (hereinafter, the “Website” or the “Portal”) is operated by Gimenez Lecuona, SLP, whose registered address is at Paseo de la Castellana 121, 9th floor, Left Wing, 28046 Madrid.
2. ‐ Usage of the Portal
This Legal Notice (hereinafter, “Legal Notice”), establishes the conditions that regulate the use of the information society services that Gimenez Lecuona makes available to users through the Website. The aspects related to the treatment of the personal data of the Users due to the use of the Website are regulated in the Privacy Policy.
Thus, the access to and use of the Website imply that the user thereof (hereinafter, the “User”) accepts in its entirety and undertakes to comply in full with this Legal Notice, the Privacy Policy, as well as the instructions or recommendations that are indicated in each specific case.
Access to the Website is free, except for the cost of connection through the telecommunications network provided by the access provider that the User has contracted.
Gimenez Lecuona reserves the right to make, at any time and without prior notice, modifications and updates of the Website and its contents, configuration and presentation, including this Legal Notice, so we recommend reading it before each access and navigation through the Portal.
The User agrees not to use the Website for fraudulent purposes, as well as not to carry out any conduct that could damage the image, interests and rights of Gimenez Lecuona or third parties, by using the Portal, the services and the contents included in it in a diligent, correct and lawful manner. In particular, the User undertakes to abstain from: suppressing, circumventing or manipulating the “copyright” and other data identifying the rights of their owners incorporated into the contents of the Portal, as well as the technical protection devices, or any information mechanisms that could include said contents. Likewise, the User undertakes not to perform any act in order to damage, disable or overload the Website, or to prevent, in any way, the normal use and operation thereof.
If you breach this Legal Notice, or if Gimenez Lecuona reasonably suspects that you are in such breach, Gimenez Lecuona reserves the right to limit, suspend or terminate your access to the Website, adopting any technical measure necessary for that purpose. Gimenez Lecuona also reserves the right to decide, at any time, on the continuity of the services provided through the Portal.
3.- Intellectual and industrial property
Intellectual property rights over the disposition of the contents of the Website (including the sui generis right on the database), its graphic design, distinctive signs (trademarks and trade names), underlying computer programs (including the source code), as well as the different elements that make up the Portal (texts, graphics, photographs, videos, etc.) correspond to Gimenez Lecuona, or it has the right to use and exploit them, and in this sense constitute works protected by current intellectual and industrial property legislation.
The use of the Website by the User in no way implies the transfer of any right of intellectual and/or industrial property on the Portal, its contents and/or the distinctive signs of Gimenez Lecuona. To this end, by means of this Legal Notice, except in those cases in which it is legally permitted, the User is expressly prohibited from reproducing, transforming, distributing, publicly communicating, making available, extracting and/or reusing the Website, its contents and/or the distinctive signs of Gimenez Lecuona.
The reproduction of elements or contents of the Website made for profit or commercial purposes is expressly and strictly prohibited.
4.- Limitation of Liability
The User acknowledges and accepts that the use of the Website is carried out at all times under his entire risk and responsibility, therefore Gimenez Lecuona is not responsible for the misuse or improper use that may be made of the Portal. For this purpose, Gimenez Lecuona will only be responsible for the damages that the User may suffer due to the use of the Website, when said damages are provided for in the current legislation.
In particular, Gimenez Lecuona will not be responsible for:
– The content of the linked sites through the links included in the Website. In this regard, the terms set forth in section 5 of this Legal Notice will apply.
– The damages and losses of any type caused in the computer equipment of the User by viruses, worms, Trojans or any other harmful element. The User acknowledges that the use of the Internet network involves the assumption of a risk that their computer equipment may be affected by the elements listed above. To this end, the User is responsible, in all cases, for the availability of adequate tools for the detection and elimination of harmful electronic programs.
– The damages and losses of any kind caused to the User that result in failures or disconnections in the telecommunications networks that produce the suspension, cancellation or interruption of the Website service during or prior to the provision thereof. In this regard, the User acknowledges that access to the Portal requires services provided by third parties outside the control of Gimenez Lecuona (for example: telecommunications network operators, access providers, etc.) whose reliability, quality, continuity and operation does not correspond to Gimenez Lecuona.
The inclusion of content on the Website does not constitute in any way the provision of a legal advice service. The User recognizes that, to the extent that the application of the Law to specific cases is not automatic, but may vary depending on very different circumstances, the information collected in the contents is insufficient for making decisions of any nature. The Website may include technical linking devices (links) that allow the User to access other Internet pages and portals (hereinafter, “Linked Sites”). In these cases, Gimenez Lecuona acts as a provider of intermediation services in accordance with article 17 of the LSSI, and will only be responsible for the contents and services provided in the Linked Sites to the extent that it has effective knowledge of the illegality and has not deactivated the link with due diligence. In the event that the User considers that there is a Linked Site with illicit or inappropriate content, please notify Gimenez Lecuona by writing to info@gimenezlecuona.com. In no case, this communication will entail the obligation to remove the corresponding link.
The existence of Linked Sites in no way implies that Gimenez Lecuona has any effective knowledge of the services and contents thereof in case of illegality, or that it necessarily maintains agreements with the persons in charge or owners of the Linked Sites. Neither does the existence of such links mean that Gimenez Lecuona recommends, promotes, identifies or conforms with the manifestations, contents or services provided through the Linked Sites. Consequently, Gimenez Lecuona is not responsible for the content of the Linked Sites, or their conditions of use and confidentiality policies, with the User solely responsible for checking and accepting them every time they access and use them.
The User and, in general, any natural or legal person that intends to establish a link from their page or site to the Portal, must obtain a prior written authorization from Gimenez Lecuona. 6.- Miscellaneous
The use of the Website is governed and interpreted in accordance with Spanish law and it will be understood that, by using the Portal, the User agrees that any dispute or litigation that arises between the user and Gimenez Lecuona will be dealt with by the competent courts in accordance with the applicable legislation.
In the event that any of the provisions contained in this Legal Notice is declared void, said provisions will be withdrawn or replaced. In any case, said declaration of nullity will not affect the validity of the rest of the provisions included in this Legal Notice.
